Town of Lake Mills
June 10, 2008

Meeting was called to order by Chairperson Heinz.  All members were
present.  Motion made by Supervisor Schroeder to adopt the agenda,
seconded by Supervisor Berns.  Carried.  Motion made by Supervisor
Schroeder to approve the minutes of the May 13, 2008 town board
monthly meeting, seconded by Supervisor Berns.  Carried.  Motion made
by Supervisor Berns to approve the Treasurer’s Report, seconded by
Supervisor Schroeder. C carried.  Motion made by Supervisor Schroeder
to approve the General Fund Vouching of $72,489.99, seconded by
Supervisor Berns.  Carried.
    The monthly police report was read by Chief Robert Delaney who also
requested that the town board consider purchasing new snow tire for
the town’s squad car at the approximate cost of $900.00.  The town
board will consider the request at the next monthly board meeting.
    No report from the Joint Rock Lake Committee meeting was given. 
Town’s Plan Commission Chairperson Eugene Hasel reported that the Plan
Commission spend a lot of time discussing and listening to the land
owners present at the meeting regarding the proposed pier ordinance,
but did take any action on the discussion.
    *Period of Public Comment:  Carl and Delores Gates informed the town
board of drainage/water issues they were having on their property from
drainage that came from the neighboring properties and run off from
the roadway and culverts that drain other properties in the Lake
Terrace/Upper Shorewood Hills Road areas.  Supervisor Schroeder
pointed out that the drainage issue was on their private property and
could only make suggestions some of which were that they look at the
height of their retaining wall and the depth of the ditches as well as
contact the landscaper who did previous work on their property to find
solutions. (Although Mr. and Mrs. Gates did not speak at the original
period of public comment, the town board agreed to hear their comments
after an extensive discussion regarding the proposed pier ordinance
had concluded)
    Town resident James Plotz requested to have the discussion of the
pier ordinance move to the top of the agenda due to the number of
landowners present who were solely interested in that discussion.  The
discussion began as the town clerk read from notes (not official
minutes) taken at the monthly meetings of the Joint Rock Lake
Committee and the Plan Commission.  The notes consisted of questions,
comments and concerns brought up during the discussion by land owners
present at the meetings.  Several landowners present at the town board
meeting continued voicing questions and concerns regarding the
proposed ordinance, the process of enacting the ordinance, notices
regarding the ordinance, the state law and its implications to the
piers on Rock Lake verses the town’s proposed ordinance, origins of
the language of the ordinance, grandfathering clauses, the
recommendation process of the Joint Rock Lake Committee and Plan
Commission as well as review of the proposed ordinance by the DNR, the
language of  the proposed ordinance and it’s intent, runoff impact on
the lake, and the Joint Rock Lake Committee’s Long Range Plan for Rock
Lake.    No action was taken and Chairperson Heinz clarified that the
town board would not have the proposed pier ordinance on the town
board’s agenda again until the Joint Rock Lake Committee and the Plan
Commission make their recommendations.  The meetings will be posted
and published as well as posted on the town’s website.

Supervisor Berns – aye.  Motion Carried. Motion made by Supervisor
Schroeder to approve the Combo Class B Liquor and Malt Licenses to
Anand Lodging, Inc - Armit Singh, America’s Best Value Inn, Larry
Haumschild- Moe’s Place, T& D Reddy Incorporated - Debra Reddy of
London Depot, and ReMik, LLC - Kroghville Oasis, Michael Baumgartner,
seconded by Supervisor Berns. Roll Call Vote: Chairperson Heinz – aye,
Supervisor Schroeder-aye, Supervisor Berns – aye.  Motion Carried.
Motion made by Supervisor Schroeder to approve the Class A Malt
License for GHL Corporation  - Jitin Agarwal -Lake Oasis Truck Plaza,
seconded by Supervisor Berns.  Roll Call Vote: Chairperson Heinz –

Waterloo, seconded by Supervisor Schroeder. Roll Call Vote:

Berns-aye.  Carried.
Adoption of town Ordinances: Neighborhood Electric Vehicle Ordinance,
amended Emergency Slow No Wake ordinance and the amended Lake and
Subdivision Regulation Ordinance.  The ordinances were signed by the
town board and are in effect.
    Motion made by Supervisor Schroeder to approve the application to
Jefferson County’s Bridge Aid for the Culvert that was replaced on Mud
Lake Road, seconded by Supervisor Berns. Roll Call Vote: Chairperson
Heinz –aye, Supervisor Schroeder-aye, Supervisor Berns-aye.  Carried.
    Motion made by Supervisor Berns to approve the referendum to be on
the September Primary ballot asking the question of the electors to
increase the expenditures of the Highway Account by 20%, seconded by
Supervisor Schroeder. Roll Call Vote: Chairperson Heinz –aye,
Supervisor Schroeder-aye, Supervisor Berns-aye.  Carried. Chairperson
Heinz read the proposed referendum and explained that the levy per
$100,000 of assessment would be approximately $23.00.  If referendum
is passed the additional money will be used to maintain the town
roads.
    Motion made by Supervisor Schroeder to approve the North End Parking
Lot Improvements at the cost to the town of $36,977.50, seconded by
Supervisor Berns.  Carried.  The money will come out of the Rock Lake
Account which consists of funds collected from launch permits.
    No action taken on the informational discussion regarding DNR
handicap permits issued to people for the operation of electric
trolling motors.  The town board will review the town’s current
ordinance and propose language clarifying the use of DNR handicap
permits of which supersede any local ordinances regulating motors on
Mud Lake, Hope Lake and Bean Lake.
    Correspondence:  The Town Treasurer, Sharon Guenterberg read a Thank
you note from the 4th of July Fireworks Committee for our annual
donation.  Supervisor Berns noted that the town will keep the “Road
Closed” signs on Shorewood Hills Road, off to the side of the road
when not in use, in case we need them again after more rain.  
    Motion made by Supervisor Schroeder to adjourn, seconded by
Supervisor Berns.  Carried.
These minutes are unapproved.  Any corrections made thereto will be
noted in the proceedings of the next meeting in which they are
approved.
