September 2, 2008 Joint Rock Lake Committee

Meeting Minutes, Tuesday September 2, 2008, 6-8pm at Lake Mills City
Hall
Chairperson Glenn Zastrow called the meeting to order at 6:05p.m.

Board Members Present: Melissa Fehrman, Stanley Smoniewski, Bob
Wardall, Glenn Zastrow, and Tom Pezzi.
Others Present: 4 Township residents, Patricia L. Cicero, Water
Resources Management Specialist for Jefferson County, Jim Heinz,
Chairperson, Town of Lake Mills, and Gene Hasel

The agenda was accepted with changes, Bob Wardall motioned and Tom
Pezzi seconded. Changes to the agenda included adding under the Town
and City reports to add North End Parking Lot and Osprey Platform. The
regular meeting minutes for August were approved, Tom Pezzi motioned
and Bob Wardall seconded. The buoy meeting minutes were approved, Bob
motioned, Tom seconded. Notice of the meeting was published in the
Lake Mills Leader.


Town and City Report: No reports from the Town or the City. 
    
    Patricia Cicero reported on the North End Parking Lot and said they
had received only two bids and both bids were high which was
disappointing. The Parks Committee met today and the prices were high
because of the asphalt and the porous asphalt may also be the reason
there were only two bids. They will be rebidding the project and have
bidders add on the asphalt as 1 & 2 and they will also add on the rain
gardens and signage. There is an opportunity to get more money through
the Waterway Commission the only problem there would be that they
could possibly lose the money that is currently in the budget for this
year. They do have areas in the bids were they can save money and that
is with the rain gardens as they will be having volunteers do the
planting.

    Patricia Cicero reported that ATC will be supplying and putting up
an Osprey pole in Korth Park in November. The hopes are that in the
spring, Osprey will nest.

    There was additional discussion on the shelter at Korth Park it is
almost done, the brick work is from bricks that were saved from the
old farmhouse and the barn boards that were used are from the old barn
at what is now Korth Park.

Old Business: Discussion of proposed amendments to Town Ordinance
5-6, Regulations for Placement of Piers. Jim Heinz is planning to call
Dave Walz with questions about swimming rafts and inflatables and if
they fall under Town jurisdiction or City jurisdiction. Patricia
Cicero recommended calling Pam Biersach and Bob Wardall provided Pam’s
phone number. There was discussion if the September 17, 2008 meeting
should be held or if it should be postponed until a later date after
clarification what is Town jurisdiction on the lake and what is City
jurisdiction on the lake it was decided that the meeting would
continue as planned on September 17, 2008 and that Jim Heinz would
speak with the DNR to find out what is under Town jurisdiction on the
lake. Glenn Zastrow asked if the pier ordinance should be a joint
effort with the City and Town. There was discussion as to whether
mooring buoys would come under the Town ordinance or if that would be
a joint effort between the City and Town. Jim Heinz reported that with
a discussion with the City Attorney she suggested the Town drop the
ordinance.
    
    Glenn then stated that he had discussion with the City Attorney in
regards to open meeting laws and that Melissa Fehrman had sent an
email to the members of the meeting asking a question about the buoys
and that is in violation of open meeting laws. There was some
discussion on this but it was tabled until the Correspondence and
additional Public Comment and Questions section. There was discussion
on the new buoy placement as the email had brought up the question and
there are also minutes from the buoy meeting. There was an amended
motion voted in favor of 3-2 that read prior to making a decision on
the buoy placement the GPS coordinates of the current buoy placement
as well as the proposed buoy placement should be taken and then
charted on a map of Rock Lake that also shows the depth lines.

    Bob Wardall handed out the Draft of the Town Ordinance that he had
made edits to. Bob discussed his edits and they will be further
discussed at the September 17, 2008 meeting with the Town Planning
Commission.

    There was further discussion and the idea that clarification needs
to be made about ordinances regarding piers, mooring buoys, rafts and
inflatables and if the Town and City need to have similar ordinances.

Correspondence and additional Public Comment and Questions: 
Melissa Fehrman had questions regarding the steps to get items on an
agenda for the Joint Rock Lake Committee also if there was a handout
regarding the committee that she could get regarding rules, agendas,
what is expected of each position on the committee. She stated she is
trying her best if others have information they could share with her
about the rules of a committee she would appreciate it. She stated
that she has checked books out from the library regarding Roberts
Rules for meetings and that she has trouble following them she was
wondering if anyone has any information that she could read or could
tell her where to get information regarding committees and information
regarding them. Glenn has information he will forward on from a
seminar he attended.

Melissa Fehrman also wanted to make sure that the email that was
questioned previously was out in the open she did not mean for it to
be against the rules she sent it because she wanted to make sure that
people knew the buoys had been moved and she wanted to make sure the
DNR had approved it because she didn’t want to violate any rules with
the DNR. Melissa will be calling the City Attorney tomorrow to see if
she can provide information regarding open meeting laws, and other
information regarding meetings that would be helpful to a committee
member.
